Message from the President Bob Deken

Wednesday May 21, 2008 a board meeting will be held in Ball Room C of the clubhouse at 9:00 A.M.
This is a packed agenda.  The board has been meeting in open and public study sessions during the past three months in addition to the board meetings that were scheduled and completed.

This meeting on Wednesday will include for discussion recommendations from the gate committee, recycling committee and the Master Plan.  All of these will affect all of us in the community.  The board expects to hear from you.

Recently a lawsuit was filed against the IronOaks Association Board of Directors.  This action is covered under the Associations Directors and Officers liability and is therefore subject to defense by our Insurance Carrier.  The Insurance carrier, not the Board, has the right to choose the best counsel for any type of litigation.  Our insurance carrier chose Carpenter and Hazelwood to represent the Association in this matter.

Members of the Board have been asked by counsel not to comment regarding the proceedings.  This request hampers the Board in answering questions that may come up.  At the same time, in looking at the latest agenda, the past Minutes of the Board, it is clear this board is working to benefit the Association.   The homeowners that have filed this suit do not have this same restriction and are soliciting support from fellow homeowners.

Members of the board have received copies of e-mails that appear to be sent from the Unit Captains list of homeowners in specific units where the homeowner lives. Additionally,  E-mails have been sent from a source other than unit captains soliciting support.  Article IX Community Standards of the Rules & Regulations states: “Solicitors, including those distributing flyers and samples, are not allowed to operate within the community.  Any person, organization, or company found violating this policy should be reported to patrol.”  Other groups have asked to have access to this e-mail list in order to get support for their group.  This has been denied by all the boards.  When the e-mail lists were set up it was clear they would not be used for any purpose other than to inform the homeowners about Association business.  This blatant misuse of our e-mail system to solicit homeowners needs to stop.

This board is working for the benefit of the Association.  We all need to come together to support the work that needs to be done.
